Register of
Non-European States
Whilst the majority of non-European countries that have adopted some form of collective redress mechanism do not have a register, some countries have done so.
Such registers have a major publicity function, since they (according to the national system):
-
allow claimants to know if a lawsuit has already been filed in a particular field or against a given party (and build a legal strategy accordingly)
-
allow potential claimants to contest the representativity of the party that brought the action, and/or potentially cooperate with the latter for the success of the proceedings …
-
allow potential members of the class to know they are represented and then potentially recover the amounts granted on their behalf
