Dutch collective redress evaluation

Five years after its enactment, the Dutch class action regime (WAMCA) recently underwent its first comprehensive statutory evaluation mandated by Parliament. This evaluation, Five years of WAMCA, identifies significant challenges, including lengthy preliminary proceedings, insufficient clarity on admissibility requirements (eg, regarding representativeness, governance, and litigation funding), and limited procedural flexibility. The report puts forward recommendations to enhance efficiency and clarity, including introducing a qualitative representativeness test for public interest actions, providing courts greater flexibility to streamline proceedings, and considering a dual-track certification system for experienced claimant organizations.
