Czech Republic: First Class Action Concluded

The first class action brought under the Czech collective redress regime has now reached a final outcome. In OnlineADR.cz v Postýlkov s.r.o., the Prague Municipal Court delivered a judgment that has become final, marking an important procedural milestone in the early application of Act No. 179/2024 Coll., which entered into force in July 2024.


The proceedings were initiated by OnlineADR.cz on behalf of consumers who had paid in advance for children’s furniture but neither received delivery within the agreed timeframe nor reimbursement after withdrawing from their contracts.


Following certification of the class action and an opt-in period, the Court delivered its first-instance judgment on 1 July 2025. Although the defendant lodged an appeal, it failed to pay the required court fee. The appeal was therefore discontinued, and the judgment became final on 30 January 2026.


The Court upheld the claims of 52 out of 56 class members and ordered restitution totalling CZK 1.6 million. The plaintiff organisation’s remuneration was fixed at 16% of the awarded sum, determined at the certification stage with regard to the expected size of the class, the complexity of the matter, and the anticipated duration of proceedings.


At the merits stage, the defendant sought to contest the applicability of the class action regime. The Court declined to entertain that objection, holding that such arguments should have been raised during certification. The decision confirms that the Czech collective redress framework is operational and capable of producing binding outcomes in consumer disputes of this nature.


This first concluded case provides valuable insight into procedural management, certification practice, and the practical functioning of the Czech opt-in mechanism in its inaugural year.
